Terms of Service

1. Acceptance of These Terms

By accessing or using FindMyNemo (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Service.

2. Who Operates the Service

The Service is operated by Aldeia de Lobos, Turismo Rural LDA, a company registered in Portugal, with VAT number PT518287360 ("we", "us", "our"). Our full identification and contact details are set out in the Legal Notice.

3. Eligibility

You must be at least 16 years old, or the age of digital consent in your jurisdiction, whichever is higher, to create an account and use the Service. By creating an account you represent and warrant that you meet this requirement.

4. Your Account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

5. The Service

FindMyNemo is a digital platform for discovering marine fish, managing aquariums and water parameters, checking compatibility and, on eligible plans, publishing a store page. We may modify, add or discontinue features at any time.

6. Subscriptions and Payments

Paid plans (Reef, Coral and Ocean) are billed on a recurring basis through Stripe, our payment processor. By subscribing, you authorise recurring charges until you cancel. Prices are displayed before you complete checkout and may change with reasonable notice.

We do not store full payment card details. Payments are processed in accordance with Stripe's terms and privacy policy.

7. Free Plan

The free plan provides a limited set of features and aquariums. We may change the limits of the free plan at any time without prior notice.

8. Cancellation

You may cancel your subscription at any time from your account (Manage billing) or by contacting us. Cancellation takes effect at the end of the current billing period. Statutory rights, including the EU right of withdrawal, are described in our Refund & Cancellation Policy.

9. Acceptable Use

You agree not to misuse the Service, including: engaging in unlawful activity, uploading malicious or infringing content, scraping or automating access, attempting to disrupt the Service, or using the Service to harass others.

10. Intellectual Property

The Service and its content (software, text, graphics, logos, data) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.

11. User Content

You retain ownership of content you submit (for example, store details or photographs). You grant us a worldwide, non-exclusive licence to host, display and distribute that content in connection with the Service.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special or consequential damages. Our total aggregate liability is limited to the amounts you have paid us in the twelve (12) months preceding the claim. Nothing in these terms excludes or limits liability that cannot be excluded or limited by applicable law.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Portugal. If you are a consumer in the EU/EEA, you benefit from any mandatory provisions of the law of your country of residence.

Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in advance where required by law. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
